Agreement to Terms

By accessing or using Stacked Playlist Maker ("the Application", "we", "us", or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this Application.

Binding Agreements

This Application uses YouTube API Services. By using this Application, you agree to be bound by:

API Usage Restrictions

You agree to:

Use the YouTube API Services in compliance with YouTube's policies and guidelines
Not use this Application to violate any applicable laws or regulations
Not misuse or abuse YouTube's services or content
Not attempt to circumvent YouTube's rate limits or quotas
Respect copyright and intellectual property rights of content creators

User Responsibilities

API Credentials

You are responsible for obtaining and maintaining your own YouTube Data API v3 credentials
You must keep your API keys and OAuth credentials secure and confidential
You are responsible for all activity that occurs under your API credentials
You must comply with Google's quota limits and rate restrictions

Content Usage

You are responsible for ensuring you have the right to create playlists with the content you select
You must respect copyright laws and YouTube's Community Guidelines
You must not use this Application for spam, harassment, or malicious purposes
You are solely responsible for the playlists you create and share

Acceptable Use

You agree NOT to:

Use the Application for any illegal or unauthorized purpose
Violate any laws in your jurisdiction (including copyright laws)
Create automated systems that excessively access YouTube's services
Attempt to reverse engineer or modify the Application
Interfere with or disrupt the Application or servers
Use the Application to spam or harass other users

Service Availability

No Warranty

Disclaimer: This Application is provided "AS IS" and "AS AVAILABLE" without any warranties, express or implied. We do not guarantee that the Application will be uninterrupted, secure, or error-free.

Limitations

The Application depends on YouTube API Services and Google's infrastructure
YouTube may change or discontinue APIs at any time without notice
API quota limits may restrict the number of playlists you can create
We reserve the right to modify or discontinue the Application at any time

Rate Limiting

To comply with YouTube API policies, this Application implements rate limiting (500ms delays between API calls). This may affect the speed of playlist creation for large song lists.

Intellectual Property

Application Rights

The Application's code, design, and functionality are owned by Support Stack Systems BBLLC
You may not reproduce, distribute, or create derivative works without permission
All trademarks and service marks are property of their respective owners

User Content

You retain all rights to the song lists and data you upload
We do not claim ownership of your content or playlists
We do not store your uploaded files on our servers

YouTube Content

All YouTube videos, thumbnails, and metadata remain the property of their respective owners
You must comply with YouTube's Terms of Service regarding content usage
We do not host or control any YouTube content

Privacy and Data Protection

Your use of this Application is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we handle your information.

This is a client-side application - all processing happens in your browser
We do not store your API credentials, OAuth tokens, or uploaded files on our servers
All data is stored locally in your browser's localStorage
We do not sell, rent, or share your data with third parties

Limitation of Liability

Important Legal Notice: To the maximum extent permitted by law, Support Stack Systems BBLLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Exclusions

We are not liable for:

Any errors, mistakes, or inaccuracies in the Application
Personal injury or property damage resulting from your use
Unauthorized access to your YouTube account or credentials
Interruptions or cessation of the Application or YouTube services
Bugs, viruses, or other harmful code transmitted through the Application
Any content, conduct, or data of third parties on YouTube
API quota exhaustion or rate limiting issues

Maximum Liability

Our total liability to you for any claims arising from your use of the Application shall not exceed $100 USD or the amount you paid to use the Application (if any), whichever is less.

Indemnification

You agree to indemnify and hold harmless Support Stack Systems BBLLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use or misuse of the Application
Your violation of these Terms of Service
Your violation of any rights of another party
Your violation of YouTube's Terms of Service or policies
Content you create, upload, or share using the Application

Termination

Your Right to Terminate

You may stop using the Application at any time. You can delete all stored data by:

Using the "Clear All" button in the Settings page
Clearing your browser's local storage
Revoking access via your Google Account settings

Our Right to Terminate

We reserve the right to:

Modify or discontinue the Application at any time without notice
Block access if you violate these Terms of Service
Cease providing the Application for any reason

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of changes by updating the "Last Updated" date. Your continued use of the Application after changes constitutes acceptance of the modified terms.

                Important: Please review these Terms periodically to stay informed 
                of any updates. If you do not agree to the modified terms, you must stop using the Application.
            

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Vermont, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes shall be resolved through good faith negotiation first
If negotiation fails, disputes may be submitted to binding arbitration in Vermont
You agree to waive any right to a jury trial

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
